The Delhi High Court has held that in cases of abnormal fetus, leaving the final decision about pregnancy to the mother is the right choice. The court emphasized that the medical board should give a quality report in such cases. The High Court gave this arrangement on the petition of a 26-year-old married woman. This woman has filed a petition to terminate her 33-week-old fetus suffering from brain defects.
The High Court said that the medical board should interact favorably to assess the physical and mental condition of the woman. This right provides a choice to the woman whether she wants to give birth to the fetus growing in her stomach or abort it.
The Court also said that in such cases it is also important to take swift action with qualitative reports. There should be certain standard factors on which opinion should be given by the board. Along with this, the court allowed the woman to have an abortion in Lok Nayak Jayaprakash.
